Welcome to Kavach Gears — Nepal's leading women-empowered manufacturer of CE-certified riding gear. These Terms of Service ("Terms") govern your use of our website, shopping experience, and purchase of riding jackets, helmets, armour, and accessories.

By accessing kavachgears.com or making a purchase, you agree to these Terms. If you don't agree, please don't shop with us. If you have questions, message us anytime — no account needed.

About Kavach Gears

Kavach Gears Ltd. is a Nepal-based, women-led company manufacturing world-class CE-certified riding gear using internationally certified, premium-grade raw materials. We craft:

Your Account & Responsibilities

When you create a Kavach Gears account, you agree to:

✅ Provide accurate, current contact information (name, email, phone, address)
✅ Maintain the confidentiality of your password
✅ Not impersonate anyone or misuse another person's account
✅ Not use your account for illegal, fraudulent, or harmful purposes
✅ Inform us immediately if you suspect unauthorized account access

Kavach Gears is not responsible for any loss or damage resulting from your failure to keep account information secure.

Product Information & Specifications

All product descriptions, images, CE certifications, sizes, and prices on kavachgears.com are provided in good faith. However:

✅ CE Ratings Stated Per Item: Every protector shows its CE Level 1, CE Level 2, or "No Rating" clearly. This is never implied — it's always explicit.
✅ Sizing Guide Provided: Use our size finder tool before ordering. Fit depends on accurate measurement.
✅ Stock Availability: Products shown as "In Stock" are available for immediate shipment nationwide Nepal. Out-of-stock items are marked clearly.
✅ Colour & Texture Variation: Riding gear is handcrafted in Kathmandu. Minor variations in leather texture, stitching patterns, and dye lots are natural and not defects.
✅ Photos Are Representative: Product photos are taken in natural light. Actual colours may vary slightly due to monitor settings and lighting conditions.

If product specifications don't match the listing when you receive your order, contact us within 10 days for a return or refund.

Ordering & Payment
Placing an Order:

You must be 18+ years old to purchase
Orders placed via kavachgears.com are binding agreements to purchase at the listed price
We reserve the right to cancel orders that are incomplete, fraudulent, or violate these Terms

Payment Methods:

Credit/Debit Cards (Visa, Mastercard, American Express)
UPI (Google Pay, PhonePe, Paytm)
Mobile Wallets (Khalti, eSewa, Fonepay)
Bank Transfers
Cash on Delivery (COD) — available for select locations

Payment Processing:

Payment is processed immediately upon checkout. Your card/wallet will be charged once.
If payment fails during checkout, you won't be charged. Please retry or contact support.
All transactions are encrypted and secure — we never store full credit card details.
Invoices are sent to your registered email within 1 hour of successful payment.

Price & Tax:

All prices shown are in Nepali Rupees (NPR) and include applicable taxes.
Prices may change without notice, but orders are locked at checkout price.

Shipping & Delivery

Free Shipping:

Free delivery nationwide Nepal on all orders over Nrs. 5,000
Shipping fee: To be confimed while order process depending upon area, weight and urgency of shipping.

Delivery Timeline:

Kathmandu Valley & Pokhara: 2–3 business days
Tier-2 Cities (Bhaktapur, Lalitpur, Biratnagar, Itahari, Gorkha): 3–5 business days
Remote Areas: 5–7 business days

Shipping Process:

Orders are packed and shipped within 24 hours of payment confirmation
You'll receive a tracking number via email and/or SMS
Tracking updates are provided by our logistics partner (Pathao Parcel, Upaye, Nepal Can or equivalent)
* Kavach Gears is not responsible for delays caused by logistics partners, natural disasters, or government restrictions

Delivery Proof:

Signature may be required upon delivery for high-value orders
If no one is available to receive the package, the courier will attempt redelivery or hold at their facility

What if Your Order Doesn't Arrive?

Contact us within 7 days of the expected delivery date
Provide order number, tracking ID, and photos of the delivery attempt (if any)
We'll trace with our logistics partner and help resolve

Returns & Refunds (7-Day Window)

Kavach Gears offers a hassle-free 10-day return policy — because riding gear must fit perfectly to protect you.

Eligible Returns:

✅ Item received in damaged or defective condition
✅ Item doesn't match product description (wrong size, colour, or CE rating)
✅ Item doesn't fit — use our size finder first, but if it still doesn't fit, we'll accept the return
✅ Item arrived after 10 days (late delivery)

Non-Eligible Returns:

❌ Damage caused by misuse, accident, or improper care after delivery
❌ Items with cut tags or evidence of heavy wear/riding use
❌ Items soiled, stained, or washed (riding gear must be returned clean)
❌ Change of mind after 10 days (late returns)
❌ Accessories like socks, inner caps, or consumables once opened

How to Return:

Message us within 10 days: hello@kavachgears.com or chat on the website (no account needed)
Explain the reason — fit, damage, defect, or delivery issue
We'll arrange pickup — free reverse logistics for valid returns
Send back the item in original packaging if possible, with all tags attached
Refund processed — full refund issued within 5 business days of receiving the returned item back in Kathmandu

Refund Method:

Refunds go back to your original payment method (card, wallet, or UPI)
No Cash on Delivery refunds — only store credit or future purchase discount

15-Day Extended Return Window:

Kavach Gears offers a 15-day extended return window for items that don't fit after the initial 10-day period — subject to inspection and condition check. Extended returns incur Nrs. 500 logistics fee.

Warranty & Product Guarantees

CE Certification Warranty:

All CE Level 1 and CE Level 2 rated products carry a 2-year warranty against manufacturing defects
CE ratings are based on impact testing to international standards — not a personal injury guarantee

Stitching & Material Warranty:

2-year warranty on stitching, seams, zips, and material integrity
Defects caused by normal wear and tear (fading, minor scuffs) are not warranty issues
Handcrafted leather develops a natural patina over time — this is not a defect

Warranty Process:

Contact us with photos of the defect
We'll assess and arrange free repair or replacement if warranted
If repair is needed, shipping is free to and from Kathmandu

What Warranty Does NOT Cover:

❌ Damage from accidents, crashes, or misuse
❌ Wear from normal riding (fading, scuffs, creasing)
❌ Improper cleaning or storage
❌ Modifications or repairs outside Kavach Gears

Our Brand & Content:

All product designs, images, descriptions, guides, and content on kavachgears.com are owned by Kavach Gears or licensed partners
You may not copy, reproduce, or sell our designs or content without written permission
Unauthorized use of Kavach brand, logos, or product names violates intellectual property laws

Your Reviews & Photos:

When you post reviews or photos on Kavach Gears, you grant us the right to use them for marketing, testimonials, and social media
We'll credit you by name unless you opt out

Liability & Limitation of Damages

Riding Gear & Safety:

Kavach Gears provides protective riding gear to reduce injury risk — not eliminate it
CE certifications mean our gear meets impact transmission standards, but no gear can guarantee 100% injury prevention
You ride at your own risk. Kavach Gears is not liable for injuries, accidents, or damage caused by riding, regardless of the gears used
Always follow traffic laws, wear full protective gear, and ride responsibly

Website & Service:

Kavach Gears is not liable for:
- Website downtime, errors, or interruptions
- Lost data, corrupted files, or viruses (maintain your own backups)
- Third-party services (payment gateways, logistics partners)
- Indirect, incidental, or consequential damages

Maximum Liability:

Kavach Gears' total liability for any claim shall not exceed the amount you paid for the product in question
This limitation applies even if Kavach Gears has been advised of the possibility of damages

Prohibited Conduct

You agree NOT to:

❌ Use the website to post illegal, harmful, or fraudulent content
❌ Harass, threaten, or defame other users or Kavach Gears staff
❌ Attempt to hack, breach, or compromise website security
❌ Scrape product data or use automated bots
❌ Resell Kavach products without authorization (drop-shipping resellers must contact us first)
❌ Post reviews that are false, misleading, or posted by competitors
❌ Use our website for money laundering or illegal transactions

Violation Consequences:

First violation: Written warning
Repeated violations: Account suspension or permanent ban
Illegal activity: Reported to Nepal authorities

Indemnification

You agree to indemnify and defend Kavach Gears, its owners, employees, and partners from any claims, damages, or legal costs arising from:

Your violation of these Terms
Your misuse of the website or products
Your violation of any laws or third-party rights
Your riding accidents or injuries

Governing Law & Dispute Resolution

These Terms are governed by the laws of Nepal.

Dispute Resolution Process:

Direct Communication: First, try to resolve disputes by contacting us at hello@kavachgears.com
Mediation: If unresolved, we'll use third-party mediation within Nepal
Legal Action: Only if mediation fails can either party pursue legal action in Kathmandu courts

No Class Actions:
You agree to resolve disputes on an individual basis, not as part of a class action or group claim

Kavach Gears may update these Terms at any time. Changes will be posted on this page with a new "Last Updated" date. Your continued use of the website means you accept the updated Terms.
